The National Prosecution of the Union for the Defense of Democracy operates upon prior request from public bodies and authorities, as well as from any citizen, provided that the public interest of the Union in the action is duly demonstrated. Additionally, there must be clear evidence of actual damage or indications of potential harm to institutions or public policies.
In cases involving disinformation, it is necessary to demonstrate the intentionality behind the dissemination of content with the aim of causing harm or obtaining undue advantage. If the disinformation concerns public policy, its negative impact must be substantiated.
When disinformation relates to a public official, such as civil servants and public authorities, the PNDD will only intervene if it is demonstrated that the content affects the legitimacy of the public function performed, and only if the content has gained significant reach or public repercussion.
The PNDD does not take action in cases involving expressions that are inherent to political rhetoric, nor does it engage in any form of monitoring of public discourse, whether on social media or through any other means.
