EMBASSY OF BRAZIL IN BAKU
PUBLIC NOTICE
The Embassy of Brazil in Baku intends, through extensive market research, to identify an alternative property to serve as the official residence for the Ambassador, in compliance with new guidelines provided by the Ministry of Foreign Affairs of Brazil and other relevant governmental agencies. All companies, certified real estate brokers or owners of properties who wish to submit proposals under the conditions stipulated below and agree to include in the lease contract the clauses mentioned must submit their proposals no later than 24 September 2025, to the following electronic address: brasemb.baku@itamaraty.gov.br.
Employees of the Ministry of Foreign Affairs of Brazil, locally hired employees of the Embassy of Brazil in Baku and relatives or partners of both may not take part in the current market research.
2. Some of the necessary characteristics of the property to be rented are listed below:
a. Lease period: three (3) years;
b. Type of property: Furnished or semi-furnished apartment/house;
c. Dimensions: between 500m2 and 680m2 indoors;
d. Representation: the property must be adequate to house the official residence of the Ambassador of Brazil, having adequate appearance and facilities including the possibility of installing the symbols of the Republic (flag and coat of arms), so that it may be identified with Brazil by passerby from the street.
e. Location: easy access for services, close to public transportation.
f. Security: the property should preferably provide security 24/7 through physical and electronic vigilance, or otherwise guarantee security and privacy to the Ambassador, his staff and family.
g. Ease of access: the property should have adequate and secure space for parking of visiting high Government officials, Ambassadors, diplomats and Embassy staff etc.
h. Social spaces: the property should feature adequate facilities for holding official social functions, entrance lobby, large vestibule, reception hall/main dining room for dining suitable for a at least 12-seat main table and auxiliary table(s), at least one guest toilet, a large kitchen area equipped to prepare food for diplomatic receptions, an adequate pantry and a family/private dining space (“copa”).
i. Rooms: the property should offer at least four bedrooms, including a master suite preferably with closets and a home office.
j. Residence staff area: resting area, preferably with dining and in-suite bathroom facilities for day-use employees with independent access door to the outside.
k. Laundry: fully equipped laundry with washing/drying machine, preferably with adequate space for air drying of clothes and washing tank.
l. Heating, ventilation and air conditioning: heating and air-conditioning in all indoor spaces, preferably with insulation.
m. Car parking: covered garage for at least two official automobiles.
3. Only properties whose landlords agree with all the following contractual provisions - which will necessarily be included in the lease agreement - will be accepted:
i) a Diplomatic Clause that allows the termination of the contract without any burden (contractual fine) to the lessee, in the event of official severance or suspension of diplomatic relations between Azerbaijan and Brazil;
ii) A termination clause which exempts the lessee from any contractual fine in the event the Brazilian Government decides to close down the Embassy of Brazil in Azerbaijan;
iii) An early termination clause that provides for the termination of the contract at the tenant's convenience and at any time, subject to prior notice of three (3) months for due notification;
iv) The provision for the immediate termination of the contract, with the reimbursement of any security deposit and the amount of unused rent paid, in the event of structural failures in the construction that compromise the security of the property or its regular use by the lessee, or if irreversible and integral damage to the property occurs, including when caused by force majeure and unforeseeable circumstances. In the event of partial damage to the property, which temporarily prevents its regular use by the lessee, the lease and rental payments must be suspended until the completion of the property recovery works, under the responsibility of the lessor, and its reoccupation. The contract may provide for an insurance policy, paid by the lessor, that covers the total or partial destruction of the property by force majeure or unforeseeable circumstances, with the immediate termination of the contract or its suspension by the lessee, without any charges to the latter and with full reimbursement of the security deposit and the amount of unused rent paid;
v) Provision for the immediate termination of the contract, at no cost to the lessee, in the event of any failures or damages occurring in the rented property, preventing or impairing its occupation by the lessee;
vi) The full reimbursement of any security deposit - or its use to pay off unexpired rental periods - at the end of the occupation, if there is no damage to the property or its furniture, with the exception of those caused by natural wear and tear;
vii) A fixed term for the lease, with the possibility of negotiating an Additive Term with a fixed lease period at the end of the contract. Automatic renewal clause of the lease contract is prohibited.
4. Preference will be given to properties whose lessor be responsible for the total costs of all necessary adaptations.
5. Preference will be given to properties whose owners are responsible for the costs of maintenance of gardens and common areas, swimming pools, air conditioning/heating systems, generators, water filters, water tanks (or artesian wells).
6. The characteristics, facilities, maintenance conditions and state of conservation of the property to be offered should meet the legal and physical requirements as per the country's legislation.
7. The market research carried out must not incur expenses to the Embassy and any real estate commission must be paid by the Lessee in case a contract is signed, unless there is a different legal provision.
8. Rental payment will be fixed in Azerbaijani manats and made through wire transfer to the bank account informed by the Lessor.
9. The contract will be signed between the owner and their legal representative and the Embassy of Brazil, represented by the Ambassador of Brazil in Azerbaijan.
