What it is

Consular registration of marriage is based on the declaration of the Brazilian spouse and the Japanese marriage certificate. Once registered, the marriage is considered valid in Brazil.

The act must be done only once and, in order for it to produce full legal effects in Brazilian territory, the consular marriage certificate must be transferred to the 1st Civil Registry Office located in the declared domicile of the interested party in Brazil or, in the absence of residence in Brazil, to the Federal District Registry Office.

Brazilians with dual nationality

If the Brazilian spouse also holds Japanese nationality, Japanese law will apply. In this case, the spouse's name must be changed in the Japanese marriage register.

Consular registration is not possible in cases where the Brazilian with dual nationality has changed his or her name when acquiring foreign nationality. In these cases, the person concerned must apply to the courts in Brazil to have their name changed in the Civil Registry and then have the marriage transcribed.

Any changes to the surname made at the time of acquiring foreign nationality will not hinder the consular registration of the marriage.

How to apply

With the necessary documents and copies in hand, schedule the service through the e-Consular system. Check out the system tutorial here. Once the appointment has been made, you will need to go to the Consulate in person and present the original documents.

Brazilian spouses must submit:

1	Form	Completed and signed Marriage Registration Form ⚠️ Disable your browser's pop-up blocker to open the form.
2	Documents issued by the Japanese city hall	Kon in Juri Shōmeisho (婚姻受理証明書) Kon in Todokede Kisai Jiko Shōmeisho com o Tempu Shorui no Utsushi Tsuki (婚姻届出記載事項証明書添付書類の写し付き)
3	Brazilian identity document	Original and copy of passport, ID or Brazilian driver's license
4	Proof of marital status 💡 Submission is not necessary if the document is already included in Kon in Todokede Kisai Jiko Shōmeisho	Consular Declaration of Civil Status; or Civil registration certificate, as appropriate: If single: 2nd copy of birth certificate, less than 6 months old If divorced: 2nd copy of Marriage Certificate with divorce annotation less than 6 months old If widowed: 2nd copy of Marriage Certificate less than 6 months old and Death Certificate of deceased spouse

Japanese spouses must present:

1	Identity document	Valid passport
2	Declaration of no previous marriage with a Brazilian	The document must be signed in front of the consular officer. If you are unable to attend, the signature on the declaration must be notarized (面前) by a Japanese notary public (公証役場). ⚠️ Disable your browser's pop-up blocker to open the declaration template.
3	Certificate (as appropriate)	If single: Koseki Tohon (戸籍謄本) with less than three months shipping time. If divorced from a Brazilian: Marriage certificate with divorce annotation issued in Brazil If divorced from a Japanese national or a person of another nationality: Koseki Tohon (戸籍謄本) stating the divorce or Rikon Juri Shōmeisho (離婚受理証明書).

Foreign spouses must present:

1	Identity document	Valid passport
2	Declaration of no previous marriage with a Brazilian	The document must be signed in front of the consular officer. 3	Certificate (as appropriate)	If single: Birth certificate, preferably with place of birth and filiation romanized (certificates in English, Spanish or French do not need to be translated). If divorced from a Brazilian: Marriage certificate with divorce annotation issued in Brazil If divorced from a Japanese person or person of another nationality: Koseki Tohon (戸籍謄本) showing the divorce or Rikon Juri Shōmeisho (離婚受理証明書) or other document proving the divorce, if divorced from a foreigner of another nationality.

Composition of the spouses' names

The consular registration is based on the marriage registration made at the Japanese prefecture. Therefore, name changes must be requested at the time of marriage registration at the Japanese prefecture and must be included in the Japanese marriage register.

⚠️ Any change to the first name will prevent the marriage from being consularly registered, which can only be applied for in Brazil.
