General information
The consular birth registration guarantees Brazilian nationality to the registrant, who will be considered a natural-born Brazilian. As a general rule, it will be carried out based on the foreign birth certificate, which will serve to prove the birth and the registrant's parentage.
The consular birth registration cannot be carried out when a birth record has already been made, either at consular offices or at notary offices in Brazil. The issuance of a duplicate registration and/or the declaration of false information in the application may constitute the crime of ideological falsehood (Brazilian Penal Code, art. 299).
There are four (04) standard procedures, depending on the registrant’s age:
- Under 12 years of age
- Between 12 and 16 years of age
- Between 16 and 18 years of age
- Over 18 years of age
There are also possibilities for direct consular registration (without the foreign birth certificate) and special cases: children conceived through assisted reproduction; foreign children adopted by Brazilians abroad; children born out of wedlock; and registration of stillbirth or death during or after delivery.
