The Consular Section of the Brazilian Embassy in Baghdad holds the office of Notary Public and Civil Registry and can perform acts of civil registry, such as issuing birth and marriage certificates, as well as Notary acts (power of attorney, declarations, etc). You can find below relevant information about the most requested services:

MARRIAGE CERTIFICATE


The marriage certificate can be issued only if the conditions for the validity of the marriage are met, in accordance with Brazilian legislation.

Transcription in Brazil:

The Brazilian Civil Code, Law 10,406 of 1/10/2002, establishes in its Article 1544, that the marriage of a Brazilian citizen  celebrated abroad  should be recorded within 180 days from the return of one or both spouses to Brazil. Thus, Brazilian citizens are advised to make a transcript of their marriage records as soon as they return, definitely or not, to Brazil.

Documents Required for a Marriage Certificate:

Registration of marriage among Brazilians:

• Passport or Identity Card (original version and copy);
• Birth Certificate issued less than 06 (six) months (original version and copy);
• Complete and sign the Declaration of disengagement for Marriage;
• Complete and sign the Marriage Certificate Application Form.

Registration based on local certificate:

• Identification document (original version and copy) of both spouses;
• Certification of Birth issued earlier than 06 (six) months (original version and copy);
• Document showing the full name of parents (original version and copy);
• Iraqi Marriage Certificate (original version and certified translation).

     

                                                              BIRTH CERTIFICATE

General rules

Under the 1988 Constitution, the children of Brazilians born abroad are native Brazilians, as long as recorded in a Brazilian Consulate or Consular Section.

The consular Birth Certificate may be issued at any time, regardless of age of the enrollee. The procedures for issuing a Birth Certificate are as follows:

I - For children under 12 years:

• Consular Registration card and a valid copy of the first and second pages of the Brazilian parent’s passport or identity card. Original documents must be submitted for certification;
• Original version and a copy of the Iraqi birth certificate to be registered, translated by a sworn translator and legalized by the Iraqi Ministry of Foreign Affairs;
• Original version  and one copy of  the marriage certificate if the marriage has been performed in Iraq. The documents must be translated and legalized by the Iraqi Ministry of Foreign Affairs;
• A Birth Certificate application form duly completed in capital letters;
• Valid local identification card with a photo of the child;
• Valid local identification card with a photo of the parents;
• The parent or the persons responsible for registering  must appear at the Consular Section of the Embassy.

II - For minors between 12 and 16 years:

Requirements remain the same item I (1,2,3,4,5,6) above. The minor must appear at the Consular Section.

III - For minors between 16 and 18 years old:

Requirements remain the same item I (1,2,3,4,5,6) above. The minor must appear at the Consular Section assisted by either parent or legal guardian.

IV - For over 18 years:

Requirements remain the same item I (1,2,3,4,5,6) above. The registrant must  appear at the Consular Section of the Embassy. There is no need the presence of either parent.

Consular Fee: Free

Remarks:

1. The consular record of birth can only be issued  when there is no record of the same Birth Certificate  in other Brazilian Consular Office or Civil Registry Office in Brazil.

2. Naturalized Brazilians may only register and pass their nationality to children born after the naturalization.

3. Duplicates of Birth Certificates issued by this Consular Section may be issued upon payment of a US$ 5.00 fee.

4. In order to be effective in Brazil, a consular birth certificate must be transcribed in a Brazilian Civil Registry. For this it is necessary to submit the certificate issued by this Consular Section and the certified copy of the birth certificate of the Brazilian mother or father.

5. Documents provided by Iraqi authorities must be legalized by the Ministry of Foreign Affairs of Iraq and translated into English or Portuguese by a sworn translator.

6. Before being delivered to this Consular Section, documents provided by other countries must be legalized by the Brazilian Consulate or Consular Representation in that country.

Birth Registration directly  issued Directly by Consular Office (only for children under 12 years)

Once confirmed the absence of local registration of birth, the Brazilian mother must submit:

• Consular Registration card and a valid copy of the first and second pages of the Brazilian mother’s passport or identity card. Original documents must be submitted for certification;
• Application of a birth certificate duly completed in capital letters.
• Document by a hospital / doctor / midwife certifying child’s birth;
• A notarized recognition of paternity document (if applicable).

Attention: At the discretion of the Consular Authority, other documents may be required
