VITEM V – Work
Among others, a VITEM V (“Work Visa”) may be granted in connection with the pursue of any of the following activities in Brazil: (i) a formal employment relationship under which applicant is the employee (i.e., salary/remuneration paid by a Brazilian legal entity); (ii) the rendering of technical assistance services or the transferring of technology under an agreement or understanding entered into by and between foreign and Brazilian legal entities; or (iii) to work as a foreign newspaper, magazine, radio, TV or news agency correspondent.
⚠️ The grant of most Work Visas is contingent upon the prior securing of a residency authorization (“Autorização de Residência Prévia”), issued by The Ministry of Justice and Public Safety, as indicated in each case below (“Residency Authorization”).
Any stay under a Work Visa may take place in connection with any of the following activities:

formal labor relationship in Brazil (“labor relationship”) (Residency Authorization); |

II |
technical assistance services (no labor relationship), under an agreement or understanding entered into by and between foreign and Brazilian legal entities (Residency Authorization); |
|
III |
transfer of technology (no labor relationship), under an agreement or understanding entered into by and between foreign and Brazilian legal entities (Residency Authorization); |
|
IV |
work (no labor relationship) on sea cruise ships sailing off the Brazilian coast, for stays exceeding ninety (90) days (Residency Authorization); |
|
V |
work (no labor relationship) as a seaman, on a continuous basis, on a foreign ship or platform operating within Brazilian territorial waters, for stays exceeding ninety (90) days (Residency Authorization); |
|
VI |
services or assistance of a technical nature (no labor relationship) for the Brazilian Federal Government (Residency Authorization); |
|
VII |
technician, service provider, volunteer, specialist, scientist or researcher (no labor relationship), coming to Brazil in accordance with the terms of an international cooperation agreement, as recognized by The Ministry of Foreign Affairs of Brazil, to work for official, private or non-governmental entities; |

VIII |
the representation, in Brazil (no labor relationship), of financial or similar institutions, which headquarters are located abroad (Residency Authorization); |
|
IX |
the representation, in Brazil (no labor relationship), of non-profit, privately-owned entities (Residency Authorization); |
|
X |
the performance of and/or the appointment to (no labor relationship) positions, functions, jobs or titles, in connection with which Brazilian laws require local residency (Residency Authorization); |
|
XI |
work as a foreign newspaper, magazine, radio, TV or news agency correspondent; |
|
XII |
the training, in Brazil, of business methods and practices adopted by the Brazilian headquarters of a transnational economic group, provided that the employee (no labor relationship) works for a legal entity belonging to the same economic group (Residency Authorization); |
|
XIII |
the training, in Brazil, of business methods and practices adopted by a Brazilian company belonging to a transnational economic group, provided that the employee (no labor relationship) works for a legal entity belonging to the same economic group (Residency Authorization); |
|
XIV |
a professional athlete, as defined by law, under a labor relationship in Brazil with a sport, privately-owned legal entity, body or association, as per Art. 46, of Law No. 9,615/98, as amended (Residency Authorization); |
|
XV |
work (no labor relationship) on a foreign fishing ship or vessel operating in the Brazilian territorial waters by means of a lease agreement with a Brazilian legal entity (acting as lessee), for stays exceeding ninety (90) days (Residency Authorization); |
|
XVI |
the participation in a professional exchange program, under a formal labor relationship, with a legal entity operating in Brazil (Residency Authorization); and |
|
XVII |
the training (no labor relationship), in Brazil, on the operation and/or maintenance of machines, equipment or other goods locally produced. |
A - General Requirements:

Online visa application form (RER – Recibo de Entrega de Requerimento), printed out and signed by the applicant; |

Police clearance issued within the last 3 months; |

* Copy of Birth Certificate, coupled with a translation thereof into English, signed by the translator (applicant may not be the translator); |
|
6 |
* Copy of the Japan residence card (Zairyu Card); |
|

REMARKS:
* The original document must be submitted together with a copy. The original document shall be returned to the applicant.
B - Additional documents and/or remarks, according to the purpose of travel, as per items II and XI, above:
⚠️ There are no additional documents or requirements on Work Visas pertaining to items I, III, XII and XIII, above.
⚠️Kindly contact us for information on Work Visas referring to items IV to X and XIV to XVII, above.
⚠️ Further documentation may be required, as deemed necessary on a case-by-case basis.
Technical Assistance Services (item II):
There are three (03) different processing categories before The Ministry of Justice and Public Safety, to wit: (i) Regular (01-year residency); (ii) Simplified (180-day residency); and (iii) Simplified – Cases of Urgency/Emergency (180-day residency). In this connection, the Police Clearance (see item “4”, above) is NOT mandatory for applications processed as Simplified – Cases of Urgency/Emergency.
Foreign newspaper, magazine, radio, TV or news agency correspondent (item XI):
In addition to documents under “1” to “7”, above: (i) letter or statement issued by relevant news agency/company, expressly confirming: (a) name and activities of relevant news agency/company; (b) description of activities to be carried out in Brazil by applicant; and (c) full address of local offices; (ii) evidence that applicant’s remuneration shall be paid in full by a foreign person/legal entity abroad; (iii) in case of filmmaking or recording of motion pictures, with or without soundtrack, for commercial or marketing purposes, formal authorization thereof issued by The National Cinema Agency (ANCINE); and (iv) whenever applicable, a statement issued by the Brazilian producer, agent or partner, according to which the applicant shall only engage in any activities within aboriginal and/or environmental reservation areas after securing the applicable authorizations by competent authorities.
