Good Practices Guide

Access the Good Practices Guide for Regulatory Monitoring and Regulatory Outcome Evaluation here (in portuguese).

Objectives of the Evaluation

  • Measuring effectiveness: To verify whether regulations are producing the expected results.
  • Identifying side effects: To assess whether there are unintended impacts or side effects arising from the regulation. These effects may be positive or negative and must be monitored.
  • Adjusting regulations: To use the evaluation results as a basis for adjusting or reformulating regulations. If a rule is not functioning as expected, it may be necessary to amend its guidelines or implement new strategies.

Evaluation Methods

The evaluation may involve a combination of qualitative and quantitative methods, such as:

  • Data analysis: Use of statistical data to measure the impact of regulations. This may include trend analyses, comparisons before and after policy implementation, and case studies.
  • Public consultations: Gathering feedback from citizens, businesses, and other stakeholders regarding the impact of regulations.
  • Impact studies: Conducting in-depth studies on how regulation affects different sectors of society and the economy.

Challenges and Considerations

Regulatory Outcome Evaluation faces several challenges, including:

  • Inadequate data: The lack of complete or accurate data may hinder the precise evaluation of results.
  • Complexity of impacts: The effects of regulations may be complex and multifaceted, making it difficult to attribute changes to a single policy.
  • Resistance to change: Adjustments to regulations may encounter resistance from stakeholders who benefit from the current situation.

Importance of the Evaluation

Regulatory Outcome Evaluation is essential to ensure that regulations are effective and efficient. By understanding the actual impacts of regulations, regulators are able to make more informed decisions and ensure that resources are used in the best possible way to achieve the intended objectives.
