Find out about ANEEL’s Regulatory Agenda for 2026–2027, approved by ANEEL Administrative Order No. 7,030 of 2 December 2025. 

This is an important tool for transparency, dialogue and oversight, as it enables any interested party to monitor the Agency’s planning of regulatory activities.

In accordance with Law No. 13,848/2019, the Regulatory Agenda must set out the list of priority activities to be regulated during its period of validity. However, the Agency’s schedule of regulatory activities goes further and covers three categories: in addition to the Regulatory Agenda, it also includes Other Regulatory Activities and Regulatory Outcome Assessments (ARR). The Schedule sets out, within the three categories of Regulatory Activities, the planned stages for each activity. This plan may be revised at the end of each year, depending on the results of Regulatory Impact Assessments (RIAs) or changes in the context of regulatory intervention. Furthermore, the activities are grouped into four Thematic Areas, with the aim of facilitating discussions between ANEEL’s Board of Directors and the Agency’s experts to develop increasingly clear and efficient regulations.

1 - Regulatory Agenda (Law No. 13,848/2019)

It sets out the list of priority regulatory activities for which the issuance of regulations is planned during the current cycle. It serves as a tool for planning, management and public participation, and ensures transparency and predictability in the regulatory process.

It is recognised as good institutional practice and has also become a legal obligation under Law No. 13,848 of 25 June 2019, which provides for the management, organisation, decision-making process and social control of Regulatory Agencies.

The process of drawing up the Regulatory Agenda at ANEEL has been refined year on year, with the participation of the whole of society as an essential element.

Regulatory Impact Analysis - RIA

Among the activities included in the Regulatory Agenda, Decree No. 10,411/2020 established the RIA as an instrument to assess the need for and consequences of a possible new regulation, examining potential benefits, estimated costs, and alternative approaches to achieve the regulatory objective. The RIA is therefore a means of assisting regulators in improving the quality of their decisions.

2 - Regulatory Outcome Evaluations - ROE

This consists of verifying the effects arising from the issuance of a normative act, considering the extent to which the originally intended objectives have been achieved, as well as the other impacts observed on the market and society as a result of its implementation.

Its integration into the regulatory cycle of federal public bodies and entities, similarly to the RIA, was regulated by Decree No. 10,411/2020, which provides that, in the first year of each presidential term, such bodies and entities must publish their ROE Agendas and implement them by the end of that term.

The ROE, like the RIA, is a tool designed to improve regulatory action, contributing to the effectiveness, efficiency, and efficacy of government action. While the RIA seeks to support decision-making at the beginning of the regulatory cycle, the ROE concludes the cycle by evaluating the results achieved, the impacts observed, and recommendations regarding any necessary adjustments.

3 - Other Regulatory Activities

The other regulatory activities carried out by ANEEL are also conducted jointly with society, which has the opportunity to contribute to their scope through Requests for Contributions and through Public Consultations and Hearings.

In addition to the drafting and review of non-priority regulations, these activities aim to explore new contexts and potential regulatory subjects (such as studies and diagnostics, for example) in order to better define the scope of new regulations.

These activities are not mentioned in the Regulatory Agenda Ordinance and may be updated by the Agency’s Organisational Units at any time.
