Legal basis of the organizational structure and competencies

Decree nº 11.238, of October 18th, 2022

Approves the Statute and relocates and modifies Demonstrative Chart of Posts of Trust and Non-Career Appointments of the Brazilian Federal Agency for Support and Evaluation – CAPES

The President of Republic, making use of the powers attributed by the Constitution – Art. 3, caput, Item 3, Subheading A:

Art. 1st – Approves the Statute and relocates and alters the Demonstrative Chart of the Brazilian Federal Agency for Support and Evaluation – CAPES, as stablished in Annexes I and II.

Art. 2nd – Relocates, as established in Annex III, the following posts of Superior Assistance Direction (DAS), Executive Commissioned Posts (FCPE), Executive Commissioned Functions (CCE) and Executive Appointed Functions (FCE):

I- From CAPES to the Secretary of Management /Special Secretary of Bureaucracy Reduction, Management and Digital Government of the Ministry of Economy:

a) One DAS 101.6

b) Seven DAS 101.5

c) Twenty- three 101.4

d) Eleven DAS 102.3

e) Three DAS 102.2

f) Forty DAS 101.3

g) Seventeen 101.2 and

h) Two 101.1

II- From the Secretary of Management/Special Secretary of Bureaucracy Reduction, Management and Digital Government of the Ministry of Economy to CAPES:

a) One CCE 1.17

b) Seven CCE 1.15

c) Four CCE 1.13

d) Two CCE 1.03

e) Two CCE 2.13

f) Eight CCE 2.10

g) Four CCE 2.04

h) Six CCE 2.02

i) Twenty- Five FCE 1.13

j) Fifty-two FCE 1.10

k) Thirteen FCE 1.07

l) One FCE 2.07

m) One FCE 2.06

Art. 3rd – Transforms, in accordance with Art. 6, Law nº 14.204 of September 16th, 2021, as stated in Annex IV:

1- In Executive Commissioned Functions (CCE) former Superior Assistance Direction (DAS) and

2 - In Superior Assistance Direction (DAS) former Executive Commissioned Posts (FCPE).

Art. 4th – Personnel occupying Non-Career Appointments and Posts of Trust are hereby dismissed or exonerated.

Art. 5th – Applies to the following items, in accordance to Arts. 14 and 15 – Decree nº 9.739 of March 18th, 2019 – and Arts. 11 to 14 of October 15th, 2021:

I – Data register of the Federal Organization and Innovation System – Siorg.

II – Terms of Apostille

III – Rules of Procedure

IV – Relocations between CCE and FCE personnel

V – Register of modifications made in non-decree form

VI – Relocation of Posts of Trust and Non-Career Appointments

Art. 6th - Decree nº 8.977, of January 30th, 2017, is hereby revoked.

Art. 7th - The present decree takes effect in October 27th, 2022
