New measures by the International Court of Justice in Gaza
The Brazilian government welcomes the adoption, on March 28, by the International Court of Justice (ICJ), of new provisional measures, within the scope of the case filed by South Africa against Israel, based on the Convention on the Prevention and Punishment of the Crime of Genocide .
The Court observed that "the catastrophic living conditions of Palestinians in the Gaza Strip have deteriorated further, in particular in view of prolonged and widespread deprivation of food and other basic necessities." It noted that there is no longer just a risk of hunger, but rather starvation, with the death of at least 31 people, including 27 children, due to malnutrition and dehydration, according to a recent report by the United Nations Office for the Coordination of Humanitarian Affairs.
The Court reaffirmed its provisional decision from last January and urged Israel to adopt the necessary measures, in cooperation with the United Nations, to ensure the provision of basic services and humanitarian assistance to Palestinians in Gaza, including by increasing the number of land crossing points. It also urged Israel to ensure that its military does not violate the rights of the Palestinian population in Gaza, including by preventing through any action the delivery of humanitarian assistance, and to submit, within one month, a report on the adoption of the indicated measures.
By recalling the binding nature of the Court's provisional measures, the Brazilian government hopes that they can result in urgent humanitarian relief for Gaza and an environment of political dialogue that allows for a definitive ceasefire, the immediate release of all hostages and the resumption of negotiations for a two-state solution, with an economically viable State of Palestine living side by side with the State of Israel, in peace and security, within mutually agreed and internationally recognized borders.
