Public Consultation and Public Hearing nº 08/2021 - Summary and decisions concerning the contributions received
ANP assessed the relevance of each contribution received throughout the Public Consultation and the Public Hearing 08/2021. Held on 07/07/2021 by videoconference, Public Hearing No. 8/2021 aimed to present the improvements of the bidding instruments of the Second Transfer of Rights Surplus Production Sharing Bidding Round. The videoconference via Teams had around 50 participants and the transmission on the ANP's Youtube channel had around 300 views.
The public hearing was presided over by the Licensing Rounds Promotion Superintendent (SPL), Renato Silveira, and secretary by the Administrative Coordinator of the SPL, Hudson Filadelfo, in addition to the presence of Artur Watt Neto, representing the Federal Attorney at the ANP.
The Director of the ANP, Dirceu Amorelli Júnior, gave the opening speech. Then, the director shared the opening of the event with Heloisa Borges, director of the Energy Research Company (EPE), Eduardo Gerk, director of Pré-sal Petróleo SA (PPSA) and Bruno Eustáquio Carvalho, deputy secretary for Oil and Gas at the Ministry of Mines and Energy (MME), who spoke about the history, partnerships and the importance of the Second Round of Bidding for the Surplus Volumes of the Transfer of Rights, under the production sharing regime.
After the opening speech, the public hearing president listed the procedures and rules for the hearing and gave the floor to the first speaker.
Rafael Bastos from MME spoke about the main premises of the round. Subsequently, the General Technical Coordinator Kátia Almeida presented the main aspects of the draft of tender protocol and the Deputy Superintendent of SPL presented the drafts of the production sharing agreements.
The president of the public hearing gave the floor to the IBP representative, registered as an exhibitor, so that she could make her presentation.
After the presentation, there were no manifestations from the audience and the president closed Public Hearing nº 8/2021.
On June 2, 2021, the Notice of Public Consultation and Hearing No. 08/2021* was published in the Official Gazette (DOU) regarding the Second Transfer of Rights Surplus Production Sharing Bidding Round. On June 7, the rectification of the Notice of Public Consultation and Hearing No. 08/2021 was published.
The public consultation and public hearing aims are:
- To obtain support and additional information on the draft tender protocol and the drafts of production sharing agreement regarding the Second Transfer of Rights Surplus Production Sharing Bidding Round;
- To provide to the economic agents and other interested parties the possibility of submitting comments and suggestions about its contents;
- To identify, in the most extensive possible way, all the relevant aspects to the matter object of the public hearing;
- To disclose and provide transparency and legitimacy to ANP’ actions.

Public Consultation
The period of the public consultation was twenty nine (29) days and ended on 6pm of July 2, 2021.
According to the notice published in the DOU on 06/28/2021, the term of the public consultation was extended from 25 to 29 days.
During this period, the ANP received 594 contributions, 182 to the draft of tender protocol and 412 to the drafts of production sharing agreements, for the Second Transfer of Rights Surplus Production Sharing Bidding Round.
Public Hearing nº 08/2021
The Public Hearing was take place on July 7, 2021 from 2:30pm to 6pm through video conference, pursuant to ANP Resolution No. 822, of June 23, 2020, via Teams and broadcast live on the ANP channel on Youtube.

Participants interested in the Public Hearing followed the rules of the Participant Manual and other guidelines informed at the opening of the event.

The civil servants Renato Lopes Silveira and Hudson de Moraes Filadelfo were appointed to act as President and Secretary in this Public Hearing, respectively.
Registration of Stakeholders to the Public Hearing
The pre-registration form for those interested in participating in Public Hearing No. 08/2021 was removed at 6:00 pm on July 2, 2021.
Registered as exhibitors:
Interested parties registered as exhibitors who intend to make their exhibition must send a copy of the presentation to the ANP to the email This email address is being protected from spambots. You need JavaScript enabled to view it. by July 2, 2021.
Each exhibition will be limited to the time determined by the president of the hearing and will follow the order of registration. The number of exhibitors will be defined according to the registrations made and the total time foreseen.
Initially, the manifestation of individuals and 1 (one) representative of each entity will be allowed. In the event that there are additional comments by participants registered or not as exhibitors, the chairman of the hearing will proceed in a way that allows the hearing of all interested parties, observing the period defined by him for such. The members of the board will be able to question the deponent about matters directly related to the presentation made, being allowed the clarifying debate.
All manifestations will be registered electronically in order to preserve the integrity of their contents and made available here.
