Empresas pagarán 5,9 millones de reales por práctica de gun jumping

La operación no fue notificada al CADE

El 28 de junio, el Consejo Administrativo de Defensa Económica (CADE) multó a seis empresas del sector automotivo por ejecutar una operación de concentración consumada anteriormente sin la autorización del CADE, práctica conocida como gun jumping.

La operación se refiere a la realización de ocho operaciones por el Grupo Dahruj en los últimos cinco años. En julio de 2020, la Superintendencia General del CADE (SG/CADE) inició el procedimiento administrativo para investigar la operación de concentración.

Tras una solicitación de esclarecimiento del CADE, las empresas presentaron informaciones sobre las operaciones realizadas durante cinco años.

En su voto, el consejero relator Gustavo Augusto destacó que todas las operaciones notificadas fueron aprobadas sin compromisos por la Superintendencia General.

Aún según él, “no está en discusión la configuración o no de la infracción económica, ya decidida por el Tribunal del CADE, en la 224.ª Sesión Ordinaria, realizada en febrero de 2024, sino la dosimetría de las multas aplicadas”, señaló.

De esa manera, el Consejo reconoció la configuración de la infracción, en los términos del voto del consejero Gustavo Augusto.

Las empresas Automec, Andreta, Tempo, Dahruj, Arguri y Mais Distribuidora se comprometieron a pagar una contribución pecuniaria de 5,9 millones de reales al Fondo de Defensa de Derechos Difusos (FDD) del Ministerio de Justicia y Seguridad Pública (MJSP).
