Data regarding Cade's performance with respect to mergers and acquisitions indicate the agency has been more productive in 2020
The Administrative Council for Economic Defense (Cade) has all its efforts directed at providing fast and efficient answers to the market and to society in the face of the new coronavirus crisis. In this context, the numbers related to assessed transactions by the Council in 2020 shows that the performance of Cade did not reduce, particularly in regard to merger assessments during the pandemic.
According to the data collected by the General Procedural Coordination, from January to May this year, Cade assessed 170 mergers. The number exceeds the 165 cases assessed by the Council within the same period in 2019. Up to now, the electric energy sector (generation, transmission and distribution of electricity energy) is the one with most approvals of Cade for their businesses.
Regarding cases reported, there was also an increase in the period compared to the previous year. In the first five months of 2020, 178 transactions were submitted to the Council, whereas in 2019, 165 were submitted. The total approximate amount of transactions reported to Cade this year is of BRL 65.4 billion.
When it comes to the time taken to assess a transaction, it is observed that Cade – which has one of the shortest terms among antitrust agencies in the world – is even more agile in 2020. Compared to 2019, during the period from January to May, the overall average assessment time was shorter this year. In May, for example, the overall average was 31.4 days in 2020 versus 34.4 days in 2019.
With these results, Cade shows its commitment to remain active during the crisis, fulfilling its role of promoting a healthy competitive environment in the country.
