CADE's Tribunal signs an agreement on the maritime and aerial freight market

The Tribunal of the Administrative Council for Economic Defense (CADE), in the judgement session of 19 September 2018, signed two Cease and Desist Agreements (TCC, in its acronym in Portuguese) in the scope of an investigation on the maritime and aerial freight market. Under the agreement, the companies DSV Logistics S.A and UTi Worldwide Inc. shall pay, respectively, BRL 1,5 million and BRL 3,6 million in pecuniary contributions, totaling over BRL 5,1 million.

The Administrative Proceeding was filed in 2010 aiming to probe the formation of an alleged international cartel with effects in Brazil in the market of international air freights and maritime cargo, with origin or destination in Brazil. The investigation pointed out that the companies would have participated actively in concerted conducts. DSV would have been involved in discussions on the transfer of a Security Surcharge fee (SSC) and an Air Automated Manifest System fee (AAMS); while UTi would have participated in discussions regarding both the Fuel Surcharge fee (FSC) and the AAMS, besides being involved in dealings over tributary issues.

Among the defendants there are 28 legal entities and 35 individuals, totaling 63 represented, among which 18 legal entities and 9 individuals signed TCCs. (Administrative Proceeding No. 08012.001183/2009-08).
