CADE’s Tribunal approves a solution to Nestlé/Garoto case

The Administrative Council for Economic Defense – CADE homologated, on 18 October, a decisive dispatch of the commissioner Alexandre Cordeiro that stablish guidelines to be fulfilled by Nestlé Brasil to compliment of the propose offered by the company for the concentration act in wich it purchased the Chocolates Garoto S/A (AC 08012.001697/2002-89).

For the commissioner, following reports of the CADE Attorney General's Office, the General Superintendence and the Department of Economic Studies of the organ, the solutions presented by Nestlé addressed all the competitive questions caused by the concentration act – judicialized since 2005 in result of the refusal of the operation by CADE in the way it was presented at that time.
