CADE’s General Superintendence launches guidance document regarding dawn raid proceedings conducted by the authority

The General Superintendence of the Administrative Council for Economic Defense – CADE released on 19 September the document “Dawn Raid Proceedings: General Information about Operationalization”.

The content was elaborated upon the best practices observed in dawn raid proceedings conducted by the authority and does not have a normative character. The goal is to keep track of the institutional memory and to serve as a reference to public servants during the proceedings related to this important activity in the implementation of competition policy and defense.

According to the Superintendence, “the dawn raids requested by CADE is a specific precautionary and restrictive measure, of exceptional character, legally authorized with the purpose of obtaining essential evidence regarding the analysis anticompetitive conduct cases, especially cartels”.

The document is divided into four topics that correspond to the main phases of this kind of operation: Case Validation; Preparation; Execution and Consolidation of the dawn raid.

The criminal operations, in which CADE operates as auxiliary of justice, remain as proceedings that are not covered in this work.
