CADE suggests amendments to bill on artificial intelligence
The Administrative Council for Economic Defense (CADE) has suggested an amendment to Substitute 2338/2023, in course at a Temporary Committee on Artificial Intelligence (CTIA) from the Brazilian Senate. The document was forwarded, as requested by Senator Eduardo Gomes (PL-TO), the rapporteur of the substitute bill.
The proposal discussed at the Brazilian Senate establishes a national system for AI regulation and governance (SIA). CADE would be part of this system that aims to provide cooperation between the agency and the sector regulators, permitting collaboration among authorities.
In the document sent to the Committee, CADE underlines the importance of establishing principles and instruments for information sharing. It also highlights the relevance of joint investigations among the members of SIA, as well as the possibility of remote access to documents and training data for high-risk AI systems. The authority also suggests developing a regulatory sandbox to enable tests on innovations before effective implementation.
The document proposes creating special criteria for risk classification of AI systems, enabling micro-entities, small companies, and startups to achieve compliance more simply and efficiently. Another suggestion is to grant the group special conditions to assess the impact of the algorithm and to implement transparency and governance measures.
Finally, CADE emphasizes that the contributions aim to clarify the SIA, so the authorities can become more collaborative and integrated, thereby fostering a regulatory framework that encourages competition and innovation in the use of AI.
