CADE signs four agreements in cartel cases

On the judgment session of 19 April 2017, the Tribunal of the Administrative Council for Economic Defense – CADE approved four Cease and Desist Agreements (TCCs, in its acronym in Portuguese) that have been negotiated by CADE’s General Superintendence. Two of them are about an alleged cartel in the market of airline and maritime international freight services in which Brazil is the origin or the destination (Administrative Proceeding 08012.001183/2009-08). The other two agreements refer to an alleged collusion in the national market of refractory ceramic rolls (Administrative Proceeding 08700.004627/2015-49).

The companies that signed the agreements regarding the international freight case are Agility Public Warehousing Company K.S.C.P, Geodis Wilson Management B.V. and Geodis Gerenciamento de Fretes do Brasil Ltda. By means of the TCC, Agility committed to pay BRL 2.25 million as a pecuniary contribution. Likewise, Geodis Wilson Management B.V. and Geodis Gerenciamento de Fretes do Brasil together will have to pay BRL 2.24 million.

The companies also committed to cease the anticompetitive conduct and to collaborate with CADE’s investigations, in addition to acknowledge their participation in the investigated practice.

The companies that signed the agreements related to the market of refractory ceramic rolls are Estiva Refratários Especiais Ltda. and Refratário Paulista Indústria e Comércio Ltda. Estiva will have to pay BRL 1.34 million as pecuniary contribution and Refratário Paulista, BRL 3.63 million. They also acknowledged their participation in the anticompetitive conduct and committed to collaborate with the investigation.
