CADE releases new edition of Revista de Defesa da Concorrência
On 25 June, the Administrative Council for Economic Defense (CADE) published the 1st edition of the biannual legal journal Revista de Defesa da Concorrência (RDC). The publication, one of the main scientific legal journals in Brazil aims at fostering the production of knowledge in Antitrust Law.
The 25th edition includes five papers from the III Rio International Workshop on Advances in Competition Policy Analysis, held in 2024. Research related to the event was regularly submitted to the RDC’s platform and assessed by peer reviewers.
The first article analyses CADE’s case law in the Brazilian basic sanitation sector since the enactment of Law 12529/2011. It highlights structural characteristics of the sector, the definition of relevant market, and the criteria used in merger reviews, exploring, for example, Sabesp’s privatisation. Other research investigates the experience with antitrust remedies in digital markets, the interaction between industrial and competition policies, and the competitive impacts of the digitalisation in the Brazilian retail sector.
Also, a particular study explores the relation between sectoral regulation and competition defence through a case study of possible conflict of jurisdiction among CADE, the Central Bank of Brazil, and the Brazilian National Telecommunications Agency (Anatel). Finally, the last article presents quantitative and qualitative methods, based on the network theory, to identify the substitutability of international routes with origin or destination in Brazil, contributing to more accurate analyses of merger cases in the international aviation sector.
About the RDC
The Revista de Defesa da Concorrência (RDC) is an electronic and open-access publication edited by CADE, which welcomes the submission of articles over the year. Researchers, students, and antitrust professionals interested in submitting their manuscripts can access the full submission instructions on the journal’s website.
Works must be original, covering topics related to antitrust law only, and written in Portuguese, English, French, or Spanish. They will be analysed anonymously, in accordance with the journal’s guidelines.
This year, the RDC celebrates its 13th anniversary. The periodical is A3 on the Qualis system, an official journal evaluation and classification system used by CAPES, body linked to the Brazilian Ministry of Education. It is considered one of the best legal journals in Brazil.
