CADE releases new edition of Revista de Defesa da Concorrência
The Administrative Council for Economic Defense (CADE) published the 24th edition of the legal journal Revista de Defesa da Concorrência (RDC). The publication, one of the main scientific legal journals in Brazil, is published every six months and aims at fostering the production of knowledge on Antitrust Law.
It has ten articles, including two from invited foreign authors, which is a new feature. The first text addresses the collusion involving artificial intelligence (AI) and its potential to drive decisions to help companies violate the antitrust law, scaping traditional control tools. Other studies analyse practical and theoretical issues, such as detecting cartels in the resale of liquefied petroleum gas (LPG) in Brazil, and the anticompetitive effects of mergers in digital ecosystems.
The journal also discusses the interaction between CADE and Open Finance, proposing a methodology to evaluate public advertising of prices and investigate possible justifications. Other articles assess constitutional matters regarding CADE’s punitive powers, the impact of leniency programmes in Brazil, and the use of trustees to monitor commitments made in agreements. These studies offer new perspectives on the enforcement of antitrust laws and policies in the country.
The last article analyses commitments made in previous mergers, highlighting the similarities with behavioural remedies, the business risks associated, and the challenges that CADE faces while monitoring these measures.
Submission of articles
The Revista de Defesa da Concorrência (RDC) is an electronic and open-access publication edited by CADE, and welcomes the submission of articles over the year. Researchers, students, and antitrust professionals interested in submitting their manuscripts for consideration can access the full submission instructions on the journal’s website.
The texts must be original, covering topics related to antitrust law only, and written in Portuguese, English, French, or Spanish. They will be analysed anonymously, taking into consideration their conformity to the publication parameters and formatting.
