CADE opens public consultation on resolution for agreement negotiations and fine collections
The Administrative Council for Economic Defense (CADE) launched a public consultation to gather contributions from the public to make a draft resolution that regulates the governance framework for negotiating agreements in court proceedings, besides the procedures for the payment and collection of fines imposed by the authority.
The document sets out clear and detailed rules on matters such as administrative instalments, discounts for cash payment with a waiver of litigation, and the governance of consensual settlements.
The draft also regulates the performance involvement of CADE’s units in these proceedings and establishes the criteria for solidary liability and piercing the corporate veil.
The initiative aims to provide detailed and systematic rules for the payment and collection of debts arising from administrative sanctions and the non-compliance with commitments made before CADE. Interested parties may submit suggestions and comments via the Participa + Brasil platform until 23 July. After the deadline, submissions will be reviewed for possible incorporation into the final version of the resolution.
