CADE fines companies for gun jumping

On 30 October, the Administrative Council for Economic Defense (CADE) fined Totalmix and Lar Cooperativa Agroindustrial for gun jumping. CADE cleared the merger in May 2024; however, according to the rapporteur of the case, Commissioner Gustavo Augusto, due to a 1,590-day delay in the notification, the case was launched, and the companies fined.

The fine was limited to 20% of the corrected value of the transaction, resulting in the amount of BRL 2,796,800.00. After the decision is published on the Brazilian Federal Official Gazette, the companies have up to 30 days to make the payment to the Brazilian Fund for De Facto Joint Rights (FDD).
