CADE finds Paraná Supermercados and Copagril guilty of gun jumping

On 11 June, the Administrative Council for Economic Defense (CADE) found the companies Cooperativa Agroindustrial Copagril and Paraná Supermercados guilty of gun jumping for completing an acquisition before the authority’s clearance.

In December 2023, an administrative proceeding was launched to investigate the  acquisition of Paraná Supermercados assets by Copagril, before CADE’s assessment of the transaction.

The contract between the parties transferred immediately and completely the commercial point in the municipality of Cianorte, in the State of Paraná, among other structural components of the supermarket.

According to Commissioner Camila Pires Alves, the rapporteur of the case, the antitrust violation is understood as a merger consummated before CADE’s approval, and required a mandatory pre-merger notification within 30 days from the publication of the decision in the Official Gazette of Brazil.

The Tribunal of CADE unanimously decided to follow the vote of the rapporteur.
