CADE establishes online decision-making system for administrative proceedings

The Administrative Council for Economic Defense (CADE) launched the “Circuito Deliberativo Virtual”, an online decision-making system to collect commissioners’ votes, dispensing with in-person meetings. The initiative aims to optimise the adjudication of matters that dismiss oral debates, making the process more efficient and transparent. 

Resolution 36/2025 established the tool after a public consultation in February. The system will be used to review official letters and several procedural and decision-making orders, including the clearance of budget proposals and the ratification of Cease and Desist Agreements. The appeals and orders may also be analysed in compliance with the Tribunal’s decisions . However, final reviews of proceedings, mergers, and consultations will still be deliberated during in-person sessions. 

The virtual sessions will be held daily, starting in the morning after the inclusion of the item in the agenda, for five consecutive days. The commissioners may request the inclusion of matters for the adjudications until 6 PM of every business day. 

Mr Alexandre Cordeiro, president of CADE, claimed that the measure shows progress in managing administrative proceedings. “The Circuito Deliberativo Virtual will help commissioners to vote remotely in specific matters, ensuring more efficiency and transparency in the decision-making process. Thus, CADE will adopt modern and digital measures assuring legal certainty”. 

The initiative is in line with the best practices from other tribunals and reinforces CADE’s commitment to the modernisation and digitalisation of the decision-making process.
