CADE and ANPD promote discussion on competition and data protection
On 2 July, the Administrative Council for Economic Defense (CADE) and the Brazilian National Data Protection Agency (ANPD) are to execute an amendment to the technical cooperation agreement established between the institutions. The ceremony will be open to the public and held online with a webinar streamed live on CADE's YouTube channel. Those interested may participate by submitting questions via electronic form.
The amendment provides for a five-year extension of the agreement, along with joint and coordinated actions in matters where the competences of competition law and data protection overlap.
Schedule
The event will start with an official opening, which will be attended by Diogo Thomson, interim president of CADE, and Waldermar Gonçalves, chief executive of ANPD.
Then, the panel “Challenges of the Digital Environment: Topics on the Agenda with Impacts on Competition and Data Protection” will feature Iagê Miola, Managing Director of ANPD, Victor Fernandes, Secretariat for Digital Rights at the Ministry of Justice, Marcela Mattiuzzo, Director of Digital Markets and Data at the Brazilian Institute of Studies on Competition, Consumer Affairs and International Trade (IBRAC), Renata Mielli, Coordinator of the Brazilian Internet Steering Committee (CGI.br), and Nicolo Zingales, Professor at Fundação Getúlio Vargas (FGV), among others. Joint Actions
The initiative between CADE and ANPD seeks to increase the effectiveness in fighting against the abusive use of data by economic agents through sharing and cooperation in analyses and investigations, including reciprocal communication on possible antitrust violations related to data protection.
For instance, CADE is responsible for notifying ANPD on the launch of proceedings against economic agents that may have committed data protection violations, while ANPD must do the same when it identifies possible antitrust violations.
The agreement also provides for cooperation in cases of mergers involving the transaction or processing of personal data, as well as joint actions in cases of non-compliance with decisions or cease and desist agreements that may affect both areas.
In addition, it establishes partnerships to undertake studies on key issues, such as the definition of the relevant market in cases of data transfers, the role of data portability as a competition enforcement tool, and antitrust violations related to data. The institutions will also promote workshops, courses, and seminars aimed at the technical improvement
of their teams in topics in which Competition Law and Data Protection overlap.
