NEW PROCEDURES OF APPLICATION FOR HUMANITARIAN VISAS FOR AFGHANS AFTER DECEMBER 30, 2024
Since December 30, 2024, after the enactment of Ministerial Ordinance MJ/MRE no.49, the rules for the issuance of Brazilian humanitarian visas (VITEM III) have been completely changed. The afore mentioned Ordinance revoked all the previous regulations concerning the humanitarian visas applications by Afghan nationals. This type of visa can no longer be requested at the Embassy. Your application will only be considered if your name is approved in advance by one of the four NGOs authorized by the Brazilian Ministry of Justice.
The Embassy of Brazil reiterates that all the applications for humanitarian visas submitted before the legal deadline of October 1st, 2023, under the previous regulations, were thoroughly examined, verified and finalized. The result of each application has been published at the bulletin board in front of the premises of the Embassy or communicated by e-mail to the applicants. All the application files previous to October 1st, 2023, have been definitively closed.
New visa interviews will not be granted and the previously issued visas that have expired without the applicant having traveled to Brazil for any reason will not be extended or renewed.
If you previously received a Brazilian an humanitarian visa and left Brazil while still holding refugee status without having been granted permission by the National Refugee Council (CONARE), your visa will not be extended or renewed either.
In any of these cases, you will have to start the application process all over again, this time, under the new rules.
Even though the Embassy has the wish to help as many people as possible, we must adhere to new laws and criteria established by the Brazilian Government for the issuance of such visas.
The Ordinance no. 49 changed the application procedure for the humanitarian visa (VITEM III). The application cannot be initiated at the Embassies of Brazil in Tehran or in Islamabad. The visa application must be initiated exclusively through civil society NGOs previously credentialed by the Ministry of Justice of Brazil. Only after this initial assessment by the NGOs, identifying the eligible candidates for the humanitarian visa, the Ministry of Justice will communicate to the Ministry of Foreign Affairs of Brazil the names of the people who will be authorized to receive the visa. The Ministry of Foreign Affairs will act accordingly and will instruct the Embassies to issue the visas, as determined by Ordinance 49 in its article 3 and paragraphs:
"Article 3º - The issuance of a temporary humanitarian visa is conditioned to the availability of shelter and material conditions for the immigrants, offered by a civil society organization credentialed by the Federal Government of Brazil, in accordance to Federal Law no. 13019, July 31st, 2014, selected by public tender.
§ 1 - The terms of the afore mentioned tender will define the role and responsibility of the Government and the civil society organization that may qualify in the tender and will determine the means of verification of the accomplishment of the agreements, being mandatory the immediate communication in case one of the immigrants leaves Brazil.
§ 2 - The temporary humanitarian visa can be processed only after the individual assessment of each applicant and the verification of the material conditions to be offered by the credentialed civil society organization.
§ 3 - Once the applicants are considered eligible for the visa the Ministry of Justice will send a communication to the Ministry of Foreign Affairs containing the list with the names of the applicants and, if the requirements of this Ordinance are fulfilled, the visa may be issued."

The Brazilian Embassy reiterates that all humanitarian visa applications submitted by Afghans by the legal deadline of October 1, 2023, under the previous legislation, were thoroughly re-examined and verified, including those referenced in street posters, emails, letters, and other communications from Afghan citizens. While the Embassy aims to assist everyone, it must now adhere to the laws and criteria established by the Brazilian government for granting these visas.
Please note that such visas do not cover cases related to domestic issues, such as abuse against children and women, health concerns, unemployment and other personal or family difficulties.

To prevent disturbing the law and order and ensure the safety of our staff and residents, a diplomatic police booth has been installed in front of the Embassy gates.

قابل توجه اتباع افغانستان
فرآیند جدید درخواست روادید بشردوستانه برای افغانها
از تاریخ ۳۰ دسامبر ۲۰۲۴، ضابطه جدیدی که توسط دولت برزیل صادر شده است (دستورالعمل شماره ۴۹)، تمامی مقررات پیشین مرتبط با درخواست ویزای بشردوستانه برای شهروندان افغان را لغو کرده است.
بر اساس این دستورالعمل جدید، تمامی درخواستها باید از طریق نهادهای بشردوستانهای که توسط دولت برزیل تعین مینماید، ارائه شوند. این نهادها مسئول ارائه خدمات اساسی مانند سرپناه، اشتغال، غذا، کمکهای بهداشتی و سایر خدمات به اتباع افغانستان هستند. هدف از این تغییر، جلوگیری از تکرار شرایط دشواری است که اخیراً پیش آمده بود، زمانی که شهروندان افغان پس از ورود به برزیل، ناچار به اردو زدن در نزدیکی فرودگاهها بودند تا به نیازهای اولیه خود دسترسی پیدا کنند.
از امروز، دو نهاد بشردوستانه در برزیل برای ارائه سرپناه انتخاب شدهاند. فهرست این نهادها در صورت انتخاب نهادهای بیشتر بهروزرسانی خواهد شد.

سفارت برزیل تأکید میکند که تمامی درخواستهای ویزای بشردوستانه که توسط اتباع افغانستان تا مهلت قانونی ۱ اکتبر ۲۰۲۳ بر اساس قوانین قبلی ارائه شده بودند، بهطور کامل بررسی و راستیآزمایی شدهاند، از جمله مواردی که دراعلانات همگانی، ایمیلها، نامهها و دیگر مکاتبات از سوی اتباع افغانستان ذکر شدهاند.

لطفاً توجه داشته باشید که این نوع ویزا شامل موارد داخلی مانند خشونت علیه کودکان و زنان، مشکلات سلامتی، بیکاری و دیگر مشکلات شخصی یا خانوادگی نمیشود.

1. I am an Afghan citizen and I want to apply for a humanitarian visa to go to Brazil. How can I do it?
On December 30, 2024, the Brazilian government issued a new regulation (Ordinance 49) that revoked all previous rules regarding humanitarian visas for Afghan citizens.
Under this new regulation, all applications will be submitted through Civil Society Organizations (CSOs) in Brazil.
As of February 2025, the Brazilian Ministry of Justice is reviewing Civil Society Organizations (CSOs) that are capable of supporting and integrating Afghans in Brazil. This review is being conducted through a Public Call Notice under Brazil’s Resettlement Program.
The results of this review will be published on our website as soon as they are available.
Important: It is currently not possible to submit individual applications for the Resettlement Program at Brazilian embassies. Nominations will be made exclusively by the CSOs approved by the Ministry of Justice.
2. So, what can be done right now to obtain a humanitarian visa to Brazil?
We kindly ask all Afghan citizens interested in applying for a humanitarian visa to refer to the NGOs credentiated by the Ministry of Justice of Brazil. Only after their assessment the Embassy can examine and process any humanitarian visa applications.
Please do not come to the embassy without an appointment. The Consular Section only assists individuals with a prior appointment. Additionally, as mentioned earlier, the new process for granting humanitarian visas depends on approval from Civil Society Organizations in Brazil.
3. I submitted a humanitarian visa request before the new Brazilian law came into effect. What should I do to find out if my visa was granted?
The Brazilian Embassy has completed the review of all humanitarian visa applications submitted by Afghans before the new Law entered into force. Each application has been carefully reviewed, including those mentioned in posters, emails, letters, and other communications from Afghan citizens.
All the application files previous to October 1st, 2023, have been definitively closed.
