Public Deed of Common-Law Union
The Embassy of Brazil in Lusaka may issue a public deed of common-law union for Brazilian nationals or for a couple composed of a Brazilian citizen and a foreign citizen holding a valid CRNM.
The declaratory public deed of common-law union is a useful instrument to prove continuous, public, and lasting cohabitation with the intention of forming a family (Brazilian Civil Code, Articles 1,723 to 1,727).
The deed of common-law union grants the couple benefits in Brazil, such as inclusion in health plans and life insurance, and facilitates proof of the union in case of separation or death of one of the partners, pension rights, division of assets, among other rights.
The common-law union, unlike marriage, does not change the civil status of the applicants.
Applicants must sign, together with two witnesses, at the time of the request for the public deed, a declaration of civil status, to prove that they are not barred from establishing the union.
The common-law union will not be established if any of the impediments listed in Article 1,521 of the Brazilian Civil Code apply.

ATTENTION: Any document that does not allow full identification of the holder, whether due to age, erasure, or tear, will not be accepted and the request will be denied.

The form must be downloaded here and filled out. The text of the declaration must be included on a separate sheet attached to the form. In case of doubts about the wording, it is advisable to seek the opinion of a lawyer or a Brazilian notary public specialized in this matter. |

Original and copy of one of the following documents: - If a Brazilian citizen, present the original Brazilian passport or national identity card (RG) or driver’s license (CNH). - If a foreign citizen, present the original valid National Migratory Registration Card (CRNM). - In both cases above, the CPF number must be provided. |

Declaration of civil status |
Click here to download the declaration. The document must be filled out on the computer, without signatures. Then, the form must be printed and brought to the consulate on the day of the appointment. |
