Public Power of Attorney (Procuração pública)
A power of attorney is the act by which a person (grantor / "outorgante") grants another person (attorney-in-fact / "outorgado") authority to act on their behalf in Brazil. Any lawful act may be delegated, except wills, personal testimony in court, and adoption.
A public power of attorney is a formal document signed before a consular officer and recorded in the Embassy’s registry. Brazilian law requires public form for certain acts; private powers of attorney are insufficient in those cases. If unsure which type is needed, consult your lawyer and the authority that will receive the document.
To require a public power of attorney, you must be a Brazilian citizen or a legal resident in Brazil with a valid Residency Card (RNM). A CPF number may also be required depending on the type of power being granted.
Steps:
1, Send an e-mail to consular.ama@itamaraty.gov.br to schedule an appointment. The e-mail must include:- the full text, in Portuguese, of the power of attorney you wish to grant
- a copy of your valid Residency Card
- your CPF number (if applicable)
- your valid Residency Card (RNM), original
- proof of payment of consular fee
