Emancipation

What it is
Emancipation is the acquisition, by a minor between the ages of 16 and 18, of the capacity to exercise certain rights, no longer depending on the consent of parents or legal representatives.
A minor may be emancipated:
- by decision of both parents;
- by decision of only one parent, in the absence of the other;
- by public instrument, or by court decision.
If one of the parents does not agree with the emancipation, it can only be decreed by a court decision.
How to apply
With the necessary documents in hand, schedule the service through the e-Consular system. See a tutorial on the system here.
⚠️ All interested parties must be Brazilian nationals.

Consular fee
Must be paid directly at the automated machines (券売機) in the Consulate's service hall. Check the fee here.
⚠️ The emancipation deed must be transcribed at the Civil Registry Office of the emancipated person's domicile.
⚠️ Emancipation is irrevocable.
