Request for WTO Consultations on Tariffs Imposed by the US on Brazil — Joint Statement by Foreign Affairs and Development, Industry & Trade Ministries
Brazil has submitted a request for consultations with the United States of America under the Dispute Settlement System of the World Trade Organization (WTO).
The request challenges tariff measures imposed through Executive Orders titled “Regulating Imports with a Reciprocal Tariff to Rectify Trade Practices that Contribute to Large and Persistent Annual United States Goods Trade Deficits” dated April 2, 2025, and “Addressing Threats to the United States from the Government of Brazil,” dated July 30, 2025. Combined, these measures may result in the imposition of tariffs of up to 50% on a wide range of Brazilian products.
The additional tariffs were adopted based on U.S. legislation, such as the International Emergency Economic Powers Act (IEEPA) and Section 301 of the U.S. Trade Act of 1974.
By imposing these measures, the United States is blatantly violating core commitments undertaken within the WTO framework, including the Most-Favored-Nation (MFN) principle and the tariff bindings negotiated under that organization.
Bilateral consultations—designed to allow the parties to seek a negotiated solution to the dispute before the possible establishment of a panel—constitute the first formal step under the WTO dispute settlement system.
The Brazilian government reiterates its willingness to engage in negotiations and hopes that the consultations will contribute to resolving the issue.
The date and venue of the consultations are to be agreed upon by the two parties in the coming weeks.
