Interministerial Ordinance on the granting of temporary visa and residence permit for humanitarian reception purposes to Afghan nationals
Interministerial Ordinance No. 42, dated September 22, 2023, was published today, September 26. This ordinance, issued jointly by the Ministry of Justice and Public Security (MJSP) and the Ministry of Foreign Affairs (MRE), establish new regulations on the issuance of temporary visa and residence permit for humanitarian reception purposes to Afghan nationals, stateless persons, and people affected by the institutional instability and the grave violation of human rights in Afghanistan.
The new regulation improves Brazil's migration policy for people affected by the institutional instability and serious violation of human rights in Afghanistan by ensuring a reception structure prior to the arrival of Afghans in Brazil.
The Interministerial Ordinance establishes that the granting of temporary visa is subject to the reception capacity of civil society organizations with which the Federal Government has signed a cooperation agreement in a public notice to be published by the Ministry of Justice and Public Security. Following the granting of the visa, which will be issued exclusively by the Brazilian Embassies in Tehran and Islamabad, entry into Brazil must occur within 180 days.
The migration regulation reaffirms the commitment of the Brazilian government to promoting the humanitarian reception of Afghan immigrants in a safe, orderly, and regular manner. The new aims to ensure that, upon their arrival in Brazil, Afghans receive a planned, organized, and dignified reception, so as to better promote their local integration and dignity, with safety and previous preparation.
