ANAC extends public consultation on changes to Brazilian Civil Aviation Regulations #01, #21 and #61 until July 3rd

The deadline for the public consultation regarding proposals to change Brazilian Civil Aviation Regulations (RBAC) # 01, #21 and #61 was extended until July 3rd. The changes are related to Theme 1 of the Regulatory Agenda: Type Design Data with Relevant Effects to the Operational Context. The deadline extension was approved by the Board of Directors of the Brazilian National Civil Aviation Agency (in Brazilian Portuguese, Agência Nacional de Aviação Civil - ANAC) during an electronic meeting held in May 15th and 16th.

People interested in submitting contributions may do so through the form available on the Public Consultations Underway webpage (click on the link for access) on ANAC’s website.

The proposed changes include updated Minimum Equipment List (MEL) and Master Minimum Equipment List (MMEL) definitions in RBAC #01;  the inclusion of requirements for MMEL and aircraft operational evaluation in RBAC #21; and  the update of requirements for granting and maintaining type ratings, improving therefore the link to the results of operational evaluation, in RBAC #61.  The Regulatory Impact Analysis (RIA) report that led to the regulatory changes mentioned beforehand is submitted for consultation as well.

The following documents are available for consultation (click on the links for acess): 

• Public consultation notice and extension notice (Portuguese only). These documents were published on the Federal Official Journal establishing July 3rd as the last day for submitting contributions; 
• Justification (English version available). These documents contain the legal basis for proposing the changes, a summary of the Regulatory Impact Assessment and a general description of normative changes; 
• Comparative chart (English version available). These highlight proposes changes on a per item basis, along with foreign regulation references and detailed explanations; 
• RBAC #01, 21 and 61 Draft (Portuguese only), compiling proposed changes into the full regulation documents; 
• Complete Regulatory Impact Assessment (RIA) report (Portuguese only);
• ANAC Resolution Draft (Portuguese only), which will be the document issued by the Board of Directors for changing the RBAC; and 
• Board of Directors decision (Portuguese only) for submitting this theme for public consultation. 

The Justification and Comparative Chart documents were translated into English in order to encourage input from foreign companies and professionals.

Queries regarding the public consultation, proposed changes or the RIA may be sent to gtni.sar@anac.gov.br until June 23rd, in order to allow a timely response before the consultation’s deadline. We reiterate that contributions to the consultation are to be sent only in writing through the submission form available on ANAC’s website. 

Explanatory Webinars  

For the sake of clarifying the regulatory changes proposed and encouraging submissions to the public consultation, the Agency promoted two webinars. During the event, the RIA and proposed changes were explained, and interested parties could also obtain information regarding queries on the subject.
